Right-of-way FAQs

What is Right-of-Way?

Right-of-Way (ROW) is land required for road construction and associated improvements like sidewalks, trails, and utilities. The amount of land needed depends on the type of road that will be built or improved and its design.

How is ROW acquired?

Usually speaking, property is acquired in three ways. The first is by donation. The second and most common method is by purchase following successful negotiation, and the third is by eminent domain or condemnation.

In general, if the City of Kyle or its consultants determines that your property - or a portion of your property - is needed, you will receive a letter and be contacted by a licensed, independent appraiser to begin the ROW acquisition process.
